It doesn't work that way (for 2 reasons).
It hasn't been released as a DLC (OHDLC or otherwise) yet. It is available as a BRRES file you can use with the ITEMTOOL patch. You will only see it in your town.
If/when it is released as a DLC item, it will overlap with the first hat slot. You probably already have the ShinyBluePikmin hat fitting that slot.

No, it means you won't be able to get it without using homebrew, which is something I don't quite understand. Why can't top quality items such as the Ash Ketchum hat, the Dimentio Mask, the pokeballs, and the Captain Falcon Helmet be released as seperate regular HDLCs? I think it's pretty obvious by now that Nintendo is not going to fill all the available slots. And if it's really about that, why can't we vote on a couple of these to make it into mainstream Wi-Fi? I thought that was the original plan anyways. Why would I even want to have these items if I can't show them off to my friends? Sure, items like the Big Axe are unneccessary "goof around" items, but if I make myself a Captain Falcon costume and am wearing a Captain Falcon Helmet no one else can see, that's really stupid to me. I've always thought HDLC was amazing, but I think this overlap stuff is starting to become lame.
Purple it doesn't matter what we vote we're always going to end up with any HDLC going public it's just the way the cookie crumbled, Rockman what it means is that anyone who doesn't have homebrew and has been visited by someone with ShinyBluePikmin will see the Hat as SBP anyone with homebrew can replace the shinyblue with the hat
