They don't care if u hack or not...they are checking your wii for the HAXX code...which can only be done if u are on wi-fi or if you have wii connect 24 on
FWIW: I'm WiFiing perfectly (HBC and lots of hacks in both towns, both GeckoOS boot and normal boot)

there may be little proof but it is happening...they are scanning the wii for the HAXX code...so it doesn't matter if ur just playing animal crossing....they only care if u have the channel....so i was informed

That's one of those inconsistencies. Wait a few days and the truth may appear (in the mean time people will go crazy with speculation)

I doubt they are scanning for the HBC. I also doubt that they can even do that with the current system updates. People who have been banned (if that error does, in fact, mean you are banned) are, most likely, cheating online in competitive games, such as Mario Kart.
Oh, and BootMii can't stop you from getting banned.
