    ANIMAL CROSSING: LET'S GO TO THE CITY ON-LINE COMPETITION
    
    TERMS AND CONDITIONS
    
    1. The competition is open to residents of the United Kingdom, Republic of Ireland, Germany, Spain, France, Belgium, and the Netherlands aged 12 or over, excluding employees of Nintendo of Europe GmbH (the "Promoter") and its affiliate companies, their families, agents and anyone else connected with this promotion.
    
    2. Maximum of three images of a potential virtual item for the Animal Crossing: Let's Go to the City game for Wii (the "Image" or the "Images") can be submitted per person.  All entries have to be submitted electronically to the Nintendo competition website between 14 April 2009 and 11 May 2009.  Entrants will be required to enter their personal details in a form on the competition website.
    
    3. The Promoter accepts no responsibility for any entry which, due to a technical error or any other reason, is not delivered or is delayed.  Only fully completed forms including all relevant entry details with an uploaded Image received during the promotional period will be accepted. Entries received by other means (including by post) will be invalid. 
    
    4. To enter, participants should upload their Images between 14 April 2009 and 11 May 2009.  Entrants are permitted to use viewing and editing software programs when creating their Image. Images and Image names/titles featuring famous celebrities or obscene content will be rejected. 
    
    5. By participating in the competition, entrants agree and confirm that: (a) the Promoter and its affiliated companies will be free to make use of their Images and/or derivative works based on their Images in any manner and for any purpose the Promoter chooses, anywhere in the world (although the Promoter will not be obliged to make any use of the Images whatsoever) and in whatever media whatsoever (whether now known or invented in the future) and that they will have no claim against the Promoter or its affiliated companies for any such use; (b) their Images are not copied from anyone else's work and that their Images are their sole and original work; (c) they hereby waive all moral and similar rights in their Images to the fullest extent possible. 
    
    6. During the period between 14 April 2009 and 11 May 2009, visitors to http://animalcrossinng.co.uk/competition/ will be invited to upload Images and vote for their favourite Images.  There will be a maximum of one vote per person per Image.  The Promoter is not responsible for any online voting which fails to be recorded for any technical reason whatsoever. Closing date for voting at http://animalcrossinng.co.uk/competition/ is 11 May 2009.  Out of the fifteen Images with the most votes recorded on the website, Nintendo will select the first prize winner. A virtual item based on the Image selected as the winner will be included as part of the Animal Crossing: Let's Go to the City game and it may be included on the Nintendo websites, the Animal Crossing: Let's Go to the City microsite, and/or as part of other Nintendo products. 
    
    7. The nickname and country of residence of the prizewinner will be posted on the Nintendo website for a period of 4 weeks starting from 21 June 2009. 
    
    8. The prizewinner will need to validate his/her age if aged 18 or over before his/her Image will be included as part of the Animal Crossing: Let's Go to the City game, and/or as part of other Nintendo products. If aged between 12 and 17 (inclusive) the prizewinner will have to submit to Nintendo a parental consent form signed by a parent or tutor which will be made available to him/her via email before his/her Image will be included as part of the Animal Crossing: Let's Go to the City game, and/or as part of other Nintendo products. The Promoter reserves the right to select an alternative winner, should an originally selected winner not validate his/her age within 3 days of being notified as a prizewinner by the Promoter or where a signed parental consent form has not been received from a prizewinner aged between 12 and 17 (inclusive) within 3 days of being notified as a prizewinner by the Promoter.  The Promoter also reserves the right to select an alternative winner in the event that it is not possible to contact an originally selected winner within 2 days of the conclusion of the voting period. 
    
    9. The prize is as stated and there are no cash alternatives.  
    
    10. The Promoter reserves the right to withdraw, suspend or amend this promotion in the event of any unforeseen circumstances outside its reasonable control, with no liability to any entrants, prizewinners or any third party.
    
    11. The result of the competition voting is final and no correspondence will be entered into.  The prizewinner may be required to participate in future publicity.
    
    12. The internet is not a secure medium and information submitted when entering this promotion may be accessed by third parties.
    
    13. This competition and these terms and conditions are governed by English law for UK residents, Irish law for Republic of Ireland residents, German law for German residents, Spanish law for Spanish residents, French law for French residents, Belgian law for residents of Belgium, and Dutch law for residents of the Netherlands. Any dispute arising out of or in connection with this competition shall be dealt with exclusively by the courts of the country in which the individual in dispute with the Promoter is resident.
    
    14. Entrants are deemed to have accepted these terms and conditions and any entry instructions on the Nintendo competition website by participating in this competition.

    Privacy Statement
    
    Nintendo will respect your privacy rights. Nintendo of Europe GmbH, with offices at Nintendo Center D-63760 Grossostheim, Germany, only makes use of and processes your personal data (name and email address) to the extent and for the time necessary to run the competition. In particular, Nintendo will not transfer your data to any third party or use/process your data for promotion or any other purposes. All personal data of those entrants who are not winners will be deleted immediately after the winners have been selected. Personal data belonging to the winners will only be retained for purposes of publication (see Competition Terms and Conditions) or until prizes have been allocated and claimed, whichever is the later, before being deleted.  By participating in the competition you consent to processing of your personal data as described above.
